This document defines the General Terms and Conditions of Sale (hereinafter the “GTC”) applicable to the services offered by THE THERAPIST travel agency, an independent company specialized in the design and marketing of tailor-made trips, wellness stays, wellness stays, retreats and therapeutic experiences for tourism purposes.

The LE THERAPIST agency, whose head office is located at 42 Rue du Cherche Midi 75006 Paris, is registered in the Trade and Companies Register under the number 90212468400017 and registered with Atout France in accordance with the regulations in force applicable to travel and stay operators. It has professional civil liability insurance from HISCOX (contract no. RCP0575448) as well as a financial guarantee issued by APST.

The services offered by LE THERAPIST may include the reservation of stays, weekends, weekends, tours, retreats, accommodations, transport, cultural or wellness activities, and other services related to tourism.
Any reservation made with the agency implies full and unreserved acceptance of these CGV, which govern the contractual relationships between THE THERAPIST and any natural or legal person wishing to benefit from its services (hereinafter “the Customer”).

Before any reservation validation, the Customer acknowledges having:

  • Acknowledging these terms and conditions and all the information
    pre-contractual agreements relating to the service chosen;
  • Accepted all of the conditions mentioned, either by electronic signature or by explicit validation via a form or a check box.

In the event of a contradiction between these GTC and a specific contract concluded with the Customer, the provisions of the particular contract will prevail.

TERMS AND CONDITIONS OF SALE OF THE THERAPIST

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sales of tourist packages and travel services offered by the LE THERAPIST agency, whether as part of tailor-made trips, wellness retreats, experiential stays or any other tourist service.

They were written in accordance with articles L.211-1 and following of the Tourism Code, which govern the activity of organizing and selling trips and stays.

They also take into account applicable European regulations and international conventions, in particular those relating to air transport.

These terms and conditions may be supplemented by the contractual conditions
specific to each service provider or third party supplier (airlines,
accommodations, insurance, etc.), according to the services included in the package booked by the Customer.

These conditions are systematically communicated to the Customer before
validation of reservation or signature of contract, and must be subject to a
express acceptance, by signature or written validation, before the reservation is considered final.

PRIOR INFORMATION

The Customer acknowledges having read these General Terms and Conditions of Sale, any specific conditions of the providers or service providers included in his trip, as well as the detailed description of the service chosen (sent in the form of a quote, brochure or personalized program).

Before any booking confirmation, THE THERAPIST systematically provides the Customer with the mandatory pre-contractual documents, in accordance with European Directive 2015/2302 transposed into the Tourism Code. This includes in particular:

  • The standard information form relating to package travel contracts or, where applicable, to isolated travel services (excluding dry flights).

In accordance with article L.211-8 of the Tourism Code, these documents inform the Customer, before the conclusion of the contract, about:

  • The main characteristics of the services offered (transport,
    accommodation, activities, etc.);
  • Full contact details of the travel organizer or agent;
  • The total price and terms of payment;
  • The conditions for cancelling and terminating the contract;
  • The insurance offered and the administrative formalities necessary for the trip (visa, passport, vaccinations, etc.).

The Customer is invited to carefully read the documents sent (quotation, program, technical sheet of the stay), which detail all the information relating to the chosen trip.

In accordance with article L.211-9 of the Tourism Code, LE THERAPIST reserves the right to modify the pre-contractual information communicated (in particular prices, content of services, identity of carriers, schedules, accommodation conditions, itineraries, etc.), within the limits provided for by law and until the signature of the contract. Any modification will be duly notified to the Customer before its final commitment.

The prices communicated are valid on the date of issue of the quotation and may be subject to revision, in particular in the event of a variation in taxes, transport costs or the exchange rate, under the conditions provided for in the CGV.

1. TOURIST SERVICE RESERVATION PROCESS

1.1 Presentation of benefits

THE THERAPIST designs, organizes and offers tailor-made tourist services, which may include accommodation, transport, wellness or cultural activities, retreats, as well as various supervised experiences.

Some services offered are provided by external partners or service providers (airlines, accommodations, therapists, speakers, etc.).

In this context, the general and specific conditions of each third party provider apply in addition to these General Terms and Conditions of Sale. These conditions cover in particular the terms of payment, cancellation, modification, reimbursement and the rules of responsibility of each person. This information is systematically sent to the Customer before the reservation is confirmed.

1.2 Booking terms

The reservation of a service offered by LE THERAPIST is made directly via the official website www.letherapist.com
The customer can:

  • request an online quote,
  • book a service from a detailed product sheet,
  • or make an appointment for a telephone, video or face-to-face exchange.

Once the request has been validated, THE THERAPIST sends the customer a personalized quote including:

  • the complete description of the service chosen,
  • the total price with details of payment deadlines,
  • the applicable cancellation and modification conditions,
  • the insurance options that may be offered,

The electronic signature of the quotation (via a secure link) accompanied by the payment of the required deposit formalizes the conclusion of the sales contract between the Customer and THE THERAPIST.

From this validation, THE THERAPIST becomes the client's sole interlocutor, guaranteeing the proper execution of the services booked, in compliance with the provisions of the Tourism Code, in particular articles L.211-1 and following.

1.4 Status of THE THERAPIST Agency

THE THERAPIST acts as:

  • travel organizer when it constructs a service including several services (tourist package),
  • and/or intermediary when certain services are booked on behalf of the Customer with partner service providers.

The general and specific conditions of third party providers are integrated into the contract, when their services are included. These conditions are communicated to the Customer before any final validation.

2.0 SERVICES AND PACKAGE PRICES

The services offered by LE THERAPIST are described in detail on the sheets produced available on the site www.letherapist.com. These sheets specify the elements included in each package or trip, including:

  • accommodation,
  • transfers or transports (if applicable),
  • supervised activities,
  • The meals mentioned
  • application fees,
  • and any other specific services indicated.

Prices are expressed in euros, all taxes included (TTC). They are displayed in real time when they are published on the site, but can be readjusted before confirmation according to changes in supplier rates, taxes or exchange rates.

Unless otherwise specified, the following are not included: optional insurance (cancellation, assistance, luggage), drinks, assistance, luggage), drinks, personal expenses, visa or passport fees, tips, any local taxes (tourist, environmental), meals not mentioned, and optional supplements (single room, New Year's Eve, extensions, etc.), meals not mentioned, and optional supplements (single room, New Year's Eve, extensions, etc.).

Any unused service, any interruption of stay by the customer, or any early departure, will not be subject to any refund, unless you take out insurance covering these cases.

3.0 PAYMENT TERMS

3.1 Payment methods

Payment for the services offered by LE THERAPIST can be made via the following means, according to the options offered on the site or during the exchange with the advisor:

  • Bank card (online via secure payment),
  • Bank transfer,
  • Any other payment method mentioned at the time of booking.

3.2 Payment by deposit and balance

For any service booked a deposit of 50% is required upon confirmation of the reservation.

For bookings made less than 10 days before the start of the trip or service, full payment is required immediately, unless otherwise specified or agreed.

4.0 PRICE REVIEW

The prices of the packages offered by LE THERAPIST are calculated based on
price information known on the day the service was published on the site www.letherapist.com These prices may be revised in accordance with articles L.211-12, R.211-8 and R.211-9 of the Tourism Code.

The price may be adjusted, both up and down, in the following cases:

  • Variation in transport costs, in particular linked to the price of fuel or
    energies,
  • Evolution of taxes and fees relating to the services included
    (airports, tourist, residential, etc.),
  • Fluctuation in the exchange rates applied to the service.

Any price change will be notified to you no later than 8 days before the departure date. In the event of an increase of more than 20%, you will receive clear and detailed communication on a sustainable medium (email), specifying:

  • the exact amount of the increase and the reasons for it,
  • its consequences on the total price of the package,
  • the possibility to cancel the contract free of charge or to accept the change.

The absence of a response from the customer within the specified period will be interpreted as a tacit acceptance of the new proposal.

5.0 ADMINISTRATIVE AND HEALTH FORMALITIES

It is the Customer's responsibility, before any reservation, to check that he meets all the administrative, customs and health conditions required for the smooth running of his trip or stay.


THE THERAPIST, via its site and its advisers, can provide general information for information purposes, in particular for French or European nationals. However, this information cannot engage its responsibility, and it is the Customer's responsibility to consult up-to-date official sources, such as:

  • The website of the Ministry of Foreign Affairs: www.diplomatie.gouv.fr, section Advice for travelers,
  • The consulates and embassies concerned.

In particular:

  • The passport should generally be valid for at least 6 months after the return date,
  • The visa (if applicable) must be obtained within the required time,
  • The vaccination certificate or other health documents may be requested depending on the destination.

For minors traveling alone, mandatory documents include:

  • An authorization to leave the country (CERFA form No. 15646*01),
  • A copy of a valid identity document of the signing legal representative,
  • An identity document in the name of the minor (passport or identity card, valid).

The family record book is not an identity document.
In the event of non-compliance or the absence of documents necessary for boarding or crossing borders, no refund may be required, and all costs incurred will remain the responsibility of the customer. The same applies to any refusal of boarding or residence by the local authorities.
Finally, it is the customer's responsibility to check the conformity between the names and first names entered during the reservation and those appearing on the identity documents (usual name, birth name, etc.).

6.0 DURATION OF THE TRIP

The duration of the stays organized by LE THERAPIST includes the days of departure and return, calculated from the time of call on the day of departure until the actual time of arrival on the day of return.
Unless otherwise specified on the Site or in the quotation, the first and last days are generally devoted to transport formalities (flights, transfers, connections) and do not necessarily include complete services on site (such as meals or activities), in particular because of the sometimes late or early morning flight schedules.

7.0 ILLUSTRATIONS AND IMAGES

The visuals appearing on the Site or in the contractual documents are non-contractual and provided for illustrative purposes. Sometimes they represent:

  • a room category different from the one actually booked,
  • a view or environment that does not correspond exactly to the situation of the assigned room.

No claim can be accepted in this respect.

8.0 AIR TRANSPORT

The conditions of air transport applicable to the trips offered by LE
THERAPIST are those defined by the airlines themselves, available on their website or recalled at the time the ticket is issued.

8.1 Schedules and changes

The timetables provided are indicative as soon as they are available. They can be changed, even after confirmation, at the initiative of the airline.
No compensation will be given for an unused seat on the way out or back.
Disruptions beyond the control of LE THERAPIST (strikes, technical incidents, delays, airport changes or unexpected stopovers) may affect the smooth running of transport. European Regulation No. 261/2004 applies in this framework, subject to its conditions of implementation.

8.2 Responsibility and regulations

Accidents and incidents occurring in the context of air transport are governed by the amended Warsaw (1929) and Montreal Conventions (1999), as well as by article L.211-17 of the Tourism Code, which may limit the liability of LE THERAPIST.
In accordance with articles R.211-15 and following of the Tourism Code, the list of airlines used is communicated at the time of booking, or at the latest 8 days before departure. A change of airline can take place up to the moment of boarding.
For charter flights lasting less than 2 hours, no meals are served. On some flights, alcoholic drinks may be subject to a charge.

8.3 Reduced mobility

In accordance with European Regulation No. 1107/2006, any passenger with disabilities or reduced mobility must inform THE THERAPIST before booking, and at the latest 8 days before departure. Transport may be refused or subject to the presence of an escort in case of incompatibility with safety requirements or the configuration of the device.

9. CLAIMS

In the event of the discovery of a breach of the agreed service, the customer must immediately inform the local representative or the guide on site in order to allow a rapid resolution.

In the absence of resolution on site, any complaint must be sent by registered mail with acknowledgement of receipt, accompanied by supporting documents, to LE THERAPIST, within 10 days following the return. Beyond this period, the processing of the file cannot be prioritized.

In the event of an unsatisfactory response within 60 days after referral to the agency, the customer may contact the Tourism and Travel Ombudsman (www.mtv.travel) or use the European online dispute resolution platform: https://webgate.ec.europa.eu/odr.

The questionnaires submitted at the end of the stay are for statistical purposes only and will not be considered as constituting elements of an official complaint.

10. LUGGAGE — PERSONAL EFFECTS

THE THERAPIST declines all responsibility in the event of loss, theft or damage to luggage or personal effects during the duration of the trip, whether in hotels or during transport. It is the customer's responsibility to report any incident to the competent local authorities (e.g. filing a complaint).

When transporting by air, the company's liability is governed by the Warsaw and Montreal Conventions, which may limit or exclude any compensation. These regimes may also benefit LE THERAPIST in the context of questioning its liability.

In the event of damage or loss of luggage, the customer must report immediately at the airport, with the competent services (carrier or airport manager).

Important recommendations:

  • No luggage insurance is included in the services offered.
  • Complementary insurance can be taken out via a service provider partner of LE THERAPIST.
  • In case of ongoing medical treatment, keep medications in cabin baggage, along with their prescription.
  • Valuable items (camera, jewelry, glasses, keys, etc.) must also be kept in cabin baggage, provided they are authorized.
  • Passengers must respect the regulations on liquids in the cabin: bottles of up to 100 ml in a transparent resealable plastic bag (20x20cm), presented separately during the security check.

11.0 RESPONSIBILITY

THE THERAPIST has all the legal and administrative authorizations required by the French authorities, ensuring the client the proper execution of the services offered.

THE THERAPIST and its service providers are responsible for the proper execution of the services agreed in the contract, and undertake to assist any traveler in difficulty. In the event of their liability under article L.211-16 of the Tourism Code, the compensation limitations provided for in article L.211-17-IV apply. Except for personal injury, intentional damage or damage caused by negligence, any compensation is capped at three times the total price of the trip.

THE THERAPIST cannot be held liable in the following cases:

  • contractual non-performance attributable to the customer;
  • intervention by a third party foreign to the provision of services;
  • exceptional and unavoidable circumstances.

In particular, full liability does not apply to the sale of dry flights or other isolated services (e.g. car rental only).
THE THERAPIST cannot be held responsible for:

  • changes in dates, schedules, itineraries or airport changes due to external events (strikes, breakdowns, weather conditions, epidemics, overloading, etc.);
  • the removal or modification of an activity or equipment on site;
  • activities or services contracted directly by the client from third parties not approved by THE THERAPIST.

12.0 INSURANCE

THE THERAPIST offers the customer, before any reservation confirmation, a link to the general conditions of the available insurance contracts (cancellation, assistance, repatriation). The customer can read and print them. When registering, the customer can subscribe to the following contract:

  • Cancellation insurance only.

In accordance with article L.112-10 of the Insurance Code, the customer justifying an equivalent guarantee already held may cancel the insurance offered by LE THERAPIST free of charge, within 14 days from the subscription, as long as no guarantee has been implemented.
Taking out insurance is optional but is strongly recommended.

13.0 CANCELLATION CONDITIONS

a. Cancellation at the initiative of the customer

In accordance with article L.221-28 of the Consumer Code, the services offered by LE THERAPIST are not subject to the right of withdrawal. Any request for cancellation must be made:

  • by telephone, using the number indicated on the booking confirmation;
  • or directly with the agency concerned.

Cancellation fees


Fees apply according to the scale in force at the time of cancellation, except for special conditions specified in the product sheet or the conditions of the provider. The following items are never refundable:

  • insurance premium;
  • visa fees, if applicable;
  • application fees;
  • ticketing fees.

Specific reimbursement conditions

  • More than 30 days before departure: refund of the deposit paid,
    after deduction of a 20% penalty.
  • Less than 30 days before departure: no refund.
  • After departure or in case of no-show: no refund.

b. Cancellation at the initiative of LE THERAPIST or a supplier

In the event of cancellation by the agency or a supplier before departure, the customer will be informed as soon as possible, by any means allowing to acknowledge receipt.


Reasons for cancellation:

  • Force majeure
  • Insufficient number of participants (cf. minimum threshold indicated on the product sheet);
  • Other circumstances beyond the control of LE THERAPIST.
    Advance notice periods (if minimum number not reached)
  • 15 days prior to departure for a trip of more than 6 days;
  • 7 days before departure for a trip of 2 to 6 days.

Proposed solutions:

The customer will be able to choose between:

  • a full refund of the amounts paid;
  • a replacement service, at the current rate.

No additional compensation may be required by the customer.

14.0 CONTRACT AMENDMENTS

The modification conditions may vary according to LE THERAPIST's partner service providers. They are specified in the specific conditions of sale of each supplier and are an integral part of the travel contract.

a. Changes at the initiative of the customer
  • Any delay in date or change of destination is generally considered to be a cancellation, subject to the conditions set out in Article 13.
  • A change of name is considered to be an assignment of contract (cf.
    Article 17) and incurs the corresponding costs.
  • Any modification made by the customer after departure (e.g.: shortened stay, unused services) will not give rise to any refund.

b. Changes at the initiative of a service provider

If, before departure, an external event within the meaning of article L.211-13 of the Tourism Code requires a supplier to modify an essential element of the contract, LE THERAPIST will inform the customer as soon as possible, by any means allowing it to be acknowledged.
The customer will be offered:

  • Or the modification of the trip;
  • Or a surrogate trip

15.0 TRANSFER OF THE CONTRACT

In accordance with article L.211-11 of the Tourism Code, the customer may transfer his contract to another person meeting the same conditions of participation, as long as no effect has been produced and up to 20 days before departure.
The transfer must be reported to LE THERAPIST within a reasonable time.
The transferor and the beneficiary remain jointly and severally liable:

  • payment of the balance of the contract;
  • transfer fees, communicated at the time of the request.

The insurance contracts taken out are not transferable.
In case of air transport, a ticket issued is neither modifiable nor refundable; in this case, the transfer of the contract may be treated as a cancellation, according to the conditions of sale of the carrier.

16.0 APPLICABLE LAW

The contractual relationships between the client and LE THERAPIST are exclusively governed by French law.
